Welcome to Zertifly! These Terms and Conditions ("Terms") govern your use of our website https://www.zertifly.com/ (the "Service") for TestDaF exam preparation. By using our Service, you agree to these Terms.

1. Service Description

Zertifly offers tools to practice speaking, writing, listening, and reading for the TestDaF exam. Our Service uses Artificial Intelligence (AI) to analyze your submissions and provide feedback. This AI analysis is a learning aid and does not guarantee any specific exam outcome.

2. User Accounts

You are responsible for maintaining the confidentiality of your account information (name, email) and for all activities under your account. You must provide accurate information.

3. User Content (Practice Data)

When you submit content (e.g., audio recordings for speaking, texts for writing), you grant us a license to use, store, analyze, and process this content to provide the Service, track your progress, and improve our AI models.
Your audio recordings are stored securely in Supabase Storage for these purposes.

4. Fees and Payments

No Refunds: All payments made for any services or products offered by Zertifly are final and non-refundable. We do not offer refunds or credits for any reason once a payment has been processed.

5. Intellectual Property

The Service and its original content (excluding your practice data) are the property of Zertifly.

6. Prohibited Uses

You agree not to use the Service for any unlawful purpose or in any way that could harm the Service or other users.

7. Termination

We may terminate or suspend your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

8. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind. We do not warrant that the Service will be error-free or that AI analysis will be perfectly accurate or guarantee exam success.

9. Limitation of Liability

To the fullest extent permitted by law, Zertifly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

10. Changes to Terms

We may modify these Terms at any time. We will post the revised Terms on our website. Your continued use of the Service after changes means you accept the new Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
